Once again, effective communication has proven to be a powerful tool in resolving workplace disputes—underscoring the continued relevance of Alternative Dispute Resolution (ADR) mechanisms implemented by the National Conciliation and Mediation Board (NCMB).

Koronadal City – On July 9, 2025, a total of P97,000 in retrenchment benefits was officially released to Ms. Retchell Fernandez, the surviving partner of a former pre-production crew member who passed away in September 2023. This came after a series of conferences facilitated by the Regional Conciliation and Mediation Branch-XII (RCMB-XII).

A testament to the power of conciliation and dialogue, Conciliator-Mediator Jemeia Mae De Eyoy successfully facilitated the resolution between the two parties during the conciliation-mediation conference. The release of the cheque and the signing of a Quitclaim and Release marked the requesting party’s satisfaction and formal closure of the Request for Assistance (RFA).

The requesting party, Ms. Fernandez, filed a RFA with RCMB-XII under the Single Entry Approach (SEnA) program on January 21, 2025. Initially treated as a claim for death benefits, the RFA experienced delays due to procedural confusion. However, after thorough coordination and review, it was clarified that the employee had been formally retrenched prior to his passingthereby entitling Ms. Fernandez to receive separation pay.

Since January 2025, Con-Med De Eyoy maintained consistent communication with both the company and Ms. Fernandez. Despite the challenges encountered throughout the process, both parties remained respectful, cooperative, and open to dialogue.

By February 2025, a mutual understanding was reached, with the requesting party agreeing to await for the release of the benefits within the projected timeline between June to August 2025. True to its commitment, the company officially released the payment on July 9, effectively bringing the matter to a close.

This resolution underscores the value of the ADR mechanisms in managing sensitive labor disputes. Through a non-adversarial, efficient, and humane approach to resolving work-related issues, ADR helps avoid the emotional and financial burdens often associated with formal litigation.
