Intramuros, Manila. A bakeshop helper who was assigned in a well-known bakeshop (referred to as the client of the responding party), received the amount of P4,561.00 representing his unpaid salary and corresponding 13th month pay, after an amicable settlement was reached between him and the responding party.
Mr. Raymond E. Avila, sought the assistance of this branch under the Single Entry Approach (SENA) program, on issues of illegal dismissal and unpaid salary. He is employed with Top Group Manpower in Binondo, Manila. On February 10, 2017, his supervisor instructed him to report to the Human Resources office due to a request for replacement by the client company. Instead of reporting to the said office, he went to this branch to file a Request for Assistance.
On February 21, 2017, the first scheduled conference, Ms. Melody Tan, representative of the responding party, gave the said amount to settle his claims. Tan also explained that he was not illegally dismissed from his employment, but relieved from his present post due to the request of the client. According to Tan, Avila is currently placed on a floating status while waiting for his new assignment. He was then advised to prepare all the documentary requirements for his next deployment.
Avila thanked Ms. Tan for the prompt action to his request and said “maraming salamat sa inyo, tinugunan nyo agad ang aking kahilingan, kailangan ko talaga ang trabaho dahil ako ay pamilyadong tao” Parties extended their gratitude to Estioco for facilitating the settlement.
SENA is a 30-day mandatory conciliation-mediation approach which aimed to provide a speedy, impartial and inexpensive settlement procedure of all labor-related issues or conflicts to prevent them from maturing into full blown cases. Lourdes P. Estioco.
